Acceptance of Terms​

By accessing and using PegBoard, you agree to be bound by these Terms of Use ("Terms") between you and Pillarxyz, Inc. ("Company," "we," "us," or "our"). If you do not agree to these terms, please do not use our service.

Description of Service​

PegBoard is a software application that enables users to generate tools and scripts for 3D modeling software including Blender, SketchUp, and Rhino.

User Responsibilities​

  • You are responsible for maintaining the security of your device and downloads
  • You are responsible for all activities that occur under your use of PegBoard
  • You must comply with all applicable laws and third-party terms of service
  • You acknowledge that certain features may collect usage data subject to your consent

Acceptable Use​

You agree to use PegBoard only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the application for any illegal, harmful, or unauthorized purpose
  • Attempt to reverse engineer, decompile, disassemble, or modify the application
  • Circumvent any security measures or access controls
  • Generate content that violates third-party terms of service or intellectual property rights
  • Interfere with or disrupt the operation of the application or related services
  • Use the application in any manner that could damage, disable, or impair its functionality

Intellectual Property​

  • PegBoard and its technology are proprietary to Pillarxyz, Inc. and protected by intellectual property laws
  • You retain ownership of content you create, subject to these Terms and applicable third-party licenses
  • You grant us a worldwide, royalty-free license to use feedback, suggestions, and anonymous usage data for service improvement
  • You represent that your use of PegBoard and any generated content does not infringe third-party rights
  • We reserve all rights not expressly granted to you

Generated Content​

  • All generated content is provided "as is" without warranties of any kind
  • You are solely responsible for testing, validating, and implementing any generated content
  • You assume all risks associated with the use of generated content
  • We disclaim all liability for the accuracy, functionality, or fitness for purpose of generated content
  • You acknowledge that generated content may contain errors or may not function as intended

Privacy​

Your use of PegBoard is subject to our Privacy Policy, which is incorporated by reference into these Terms.

Disclaimers​

PEGBOARD IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT THE APPLICATION WILL BE ERROR-FREE, SECURE, OR CONTINUOUSLY AVAILABLE.

Limitation of Liability​

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PILLARXYZ, INC. BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF PEGBOARD, REGARDLESS OF THE THEORY OF LIABILITY AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED $100.

Termination​

We may suspend or terminate your right to use PegBoard at any time for any reason, including breach of these Terms. Upon termination, your right to use PegBoard ceases immediately. Provisions that by their nature should survive termination shall remain in effect.

Changes to Terms​

We reserve the right to modify these Terms at any time. Material changes will be effective upon notice, which may be provided through the application or our website. Your continued use constitutes acceptance of modified Terms.

Governing Law and Disputes​

These Terms are governed by the laws of Delaware, excluding conflict of law principles. Any disputes shall be resolved through binding arbitration under the American Arbitration Association Commercial Rules, with proceedings in Delaware. You waive any right to jury trial or class action participation.

Miscellaneous​

If any provision is deemed invalid, the remainder shall remain in effect. These Terms constitute the entire agreement between you and Pillarxyz, Inc. regarding PegBoard. No waiver of any term shall be deemed a continuing waiver.
